SAF Lawsuit Challenging Chicago's Handgun Ban to Be Heard by Supreme CourtFollowing the 5-4 ruling by the U.S. Supreme Court in the case of District of Columbia v. Heller that the Second Amendment protects an individual civil right to keep and bear arms, and that a municipal gun ban violates that right, the Second Amendment Foundation (SAF) and the Illinois State Rifle Association (ISRA) filed a federal lawsuit challenging the City of Chicago's long-standing handgun ban. SAF Files Amici Curiae Brief in Lawsuit; DC Gun Ban Ruled UnconstitutionalThe Supreme Court has overturned the DC Gun Ban, ruling that the Second Amendment protects and individual right to keep and bear arms. SAF, CCRKBA and Madison Society, along with a dozen university law professors, filed an amicus brief in the suit to overturn the DC Gun Ban. Additionally, 13 state Attorneys General filed an amici curiae brief in support of the SAF position to protect the right to Keep and Bear Arms. SAF Sues to Overturn San Francisco Gun BanThe city appealled SAF's intial victory overturning the San Francisco Gun Ban. The California Appeals Court has unanimously ruled to uphold the lower court's decision, so SAF won again. The city then appealed to the California Supreme Court, which again ruled in SAF's favor. District of Columbia that finds the plaintiff has standing to pursue legal action against the city, opening legal doors for the pursuit of other gun rights cases including one filed by SAF challenging the restrictive wording of the 1968 Gun Control Act. Robert Ord is pursuing a legal action against the District for having issued an arrest warrant for him without probable cause because he had been hired to provide armed security at a District of Columbia school facility and he had status as a “qualified law enforcement officer” and “Special Conservator of the Peace,” which exempted him from the District’s ban on carrying firearms without a license. SAF obtained information from the mayor’s office that the overwhelming majority of citizens living both inside and outside the city turned thumbs down on the mayor’s plan to ban even legally-carried firearms in city parks facilities. The MFFA declares that any firearms made and retained in Montana are not subject to any federal authority, resisting Congress's dramatically expanded use of the interstate commerce clause to justify Washington's regulation of virtually all of the private economy.
