New York City flatly prohibits the possession of stun guns by individuals. The City also instructs its officers to enforce State law, which prohibits stun guns and tasers, despite that law being ruled unconstitutional by another federal court. 

The City’s ban on electronic arms directly conflicts Supreme Court precedent which found that such arms were protected by the Second Amendment, despite not being in existence at the time of the Founding. The Court also determined that electronic arms, such as stun guns, were in common use. 

On March 9, 2021, the Second Amendment Foundation filed suit, along with another civil rights organization, and two individuals. The lawsuit asks a federal court to declare that the state and city bans violate the Second and Fourteenth Amendments and enjoin the Defendants from enforcing the bans.
