On July 1, 2022, New York Governor Kathy Hochul signed S51001 into law, amending New York’s gun laws, which among other things, implemented an expansive new ban on areas where a person could lawfully carry a handgun – many of which were previously unregulated.
Some of those areas included, among others, public parks, public transportation, and private property where the owner or lessee has not posted that the carrying of arms is permissible. The law made carrying a firearm in these designated areas a felony offense.
On September 13, 2022, the Second Amendment Foundation, joined by another civil rights organization and two individuals filed suit challenging New York’s carry ban. The lawsuit asks a federal court to enjoin various provisions of the law prohibiting the carriage of firearms in public parks, on public transportation, and on private property unless posted and declare those provisions unconstitutional.
