The California Unsafe Handgun Act (UHA), commonly known as the California Handgun Roster, sets forth the specific models of handguns that are available for sale from licensed dealers in California. For new models to be added to the Roster, they must be equipped with certain features, including a loaded chamber indicator, magazine disconnect safety and microstamping technology.
To date, no new, commercially available models fulfill all of the requirements, resulting in only handguns that were grandfathered in upon the law’s passage being approved for inclusion on the Roster. That outdated and ever-dwindling list of available handguns represents only a small fraction of the makes and models of constitutionally protected handguns in common use across the country, thus severely limiting the ability of peaceable Californians from acquiring those arms.
On November 10, 2020, the Second Amendment Foundation filed suit, along with a number of individuals, California licensed firearms retailers, and three other advocacy groups. The lawsuit seeks declaratory and injunctive relief, asking the Court to strike down various elements of the UHA as its ongoing enforcement deprives the Plaintiffs of their Second and Fourteenth Amendment rights.
